Terms of Service — Exercisable

1. Acceptance of Terms

By accessing or using Exercisable (“the Service”), operated by Exercisable GmbH, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Exercisable provides an all-in-one coaching platform that allows coaches to manage clients, build workout programs, track progress, handle payments, and grow their coaching business.

3. Accounts & Registration

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You agree to provide accurate and complete information during registration and to keep it up to date.

4. Subscriptions & Payments

The Service offers a free tier (1 client) and paid subscription plans (monthly and annual).
Paid plans include a 14-day free trial. A valid credit card is required to start a trial.
Subscription fees are billed in advance on a recurring basis (monthly or annually) depending on your selected plan.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
We reserve the right to change pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance.

5. User Content & Data

You retain ownership of all content and data you upload to the platform (workout programs, client data, media, etc.).
You grant us a limited license to host, store, and display your content solely for the purpose of providing the Service.
You are responsible for ensuring that you have the necessary rights and consents to upload and share any content, including client data.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Upload content that is defamatory, obscene, or infringes on third-party rights
Attempt to gain unauthorized access to the Service or its related systems
Interfere with or disrupt the integrity or performance of the Service
Resell or redistribute the Service without written authorization

7. Intellectual Property

The Service, including its design, code, logos, and content (excluding user content), is the property of Exercisable GmbH and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a reasonable period following termination.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Exercisable GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Exercisable is incorporated, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
